DRYCLEANER ENVIRONMENTAL RESPONSE TRUST FUND
COUNCIL of ILLINOIS

GOVERNOR'S OFFICE
SPRINGFIELD, ILLINOIS

JUNE 16, 2005

The Council held a special Council meeting on Thursday, June 16, 2005, at the Governor's Office in Springfield , IL . John Polak , Chairman, called the meeting to order at 2:05 p.m. Roll call was taken with the following Council members present:

Also present were:

Jill Hayden, Governor Blagojevich's Office
Carolyn Krause, Office of Management and Budget
Robert Greenlee, Office of Management and Budget (via telephonic conference)
H. Patrick Eriksen, Program Administrator's Office
John McCarthy, Program Counsel

The purpose of the special Council meeting was to conduct a discussion of the financial affairs of the Illinois Drycleaner Environmental Response Trust Fund with representatives of the Governor's Office and Office of Management and Budget. Specifically addressed during the discussions was the proposed transfer of $1,137,971 as authorized in SB661 that was passed by the legislature in May 2005 and discussion of the administrative charge backs that were part of the FY05 revenue bill.

Mr. Eriksen and Mr. Polak reviewed in detail the Fund's current financial condition. This included the following documents:

  1. May 31, 2005 cash flow analysis
  2. May 31, 2005 monthly activity report
  3. Fund financial projections for the period of January 1, 2005 through January 1, 2020
  4. Claims statistics
  5. May 31, 2005 financial statements
 

After general discussion, it was the concurrence of the Governor's Office and the Office of Management and Budget that the Council should request the Comptroller's Office pend the transfers until the financial status of the Fund could be reviewed in more detail. Mr. Kevin Schoben of the Comptroller's Office, joined the meeting and indicated that he would review SB661 in detail to determine what flexibility the Comptroller had in regards to pending the transfer of monies as outlined in the bill. It was the consensus of those in attendance the next step would be to wait for an answer from the Comptroller's Office as to whether the law clearly mandated them to make the quarterly transfers. Mr. Greenlee indicated the Office of Management and Budget did not anticipate that the Fund would be subject to another administrative charge back in fiscal year 2006.

There being no further business, the meeting adjourned at 3:20 p.m.
